DEFINITIONS:

1. “GeeMyCard” means JFrenz Pty Ltd (ACN 129 179 924) and includes GeeMyCard’s employees, agents, contractors, officers and related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)).

2. “Applicant” means an individual who has made an application to become a member of GeeMyCard.

3. “Member” means an individual who has been accepted to the GeeMyCard membership program by GeeMyCard.

4. “Card” means a membership card issued to a Member upon approval of application to the GeeMyCard membership program.

5. “Participating Business” means a business affiliated with GeeMyCard membership program, as advised to you by GeeMyCard from time to time.

To apply for GeeMyCard membership and become a Member, the Applicant must be18 years of age or older and fully complete a membership application form, submit the form and pay the membership fee at any GeeMyCard authorised stores.

By applying to join GeeMyCard membership program the Applicant accepts and agrees to be bound by these terms and conditions.

Only individuals can apply for a Card and a Member may hold only one Card. GeeMyCard may, in its absolute discretion accept or refuse any application for membership.

Member rights are determined by GeeMyCard from time to time and may include discounts for products purchased at GeeMyCard participating businesses, invitations to exclusive events and entry to promotions.

Membership benefits only apply to the Member and may not be used in conjunction or combination with any other discounts, offers or promotions unless specified otherwise by GeeMyCard participating business in its promotional material.

Member must produce their Card if seeking any discount or other benefit offered to Members, or upon request by all participating businesses.

The Card remains the property of GeeMyCard at all times and must be returned to GeeMyCard immediately upon demand by GeeMyCard.

GeeMyCard may, in its absolute discretion, at any time and without notice or giving reasons for its decision, terminate membership of any Member and cancel the Card.

Member rights are valid until terminated or cancelled by GeeMyCard (in its absolute discretion) or until the Member notifies GeeMyCard that he or she wishes to terminate their membership. If membership is terminated, the Member must return the Card to GeeMyCard authorised shops. Termination of membership does not take effect until the Card is returned. No refund will be given if membership is terminated by the Member.

GeeMyCard is not responsible for stolen or lost Cards or Cards that are used fraudulently. Member must report a stolen or lost Card to GeeMyCard immediately. The Member's existing Card will be cancelled and a new Card issued at the cost of the membership fee.

GeeMyCard reserves the right to amend or terminate the membership program, and its associated programs/promotions, at any time without prior notice.

GeeMyCard shall not be liable in any way if benefits or discounts offered by Participating Businesses are unavailable for any reason.

All discounts for Members for purchases at GeeMyCard participating businesses are subject to availability.

Members discounts are not negotiable, non transferable and are not redeemable for cash.

GeeMyCard does not warrant in any way that any discounts or benefits for Members will be available at any particular time or times or in any particular place.

GeeMyCard gives no warranty or representation as to the quality, suitability or merchantability of any goods or services and shall have no liability in respect of goods or services provided to Members (including those offered as prizes in promotions or competitions) or as to the accuracy of any description or information about such goods or services of Participating Businesses.

GeeMyCard is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by any Member whether by reason of any act or omission, deliberate or negligent, of GeeMyCard in connection with the membership program, including injury or loss incurred whilst participating in any activity of the membership program or GeeMyCard or in any activity in which Members or their pets are invited to participate. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the fullest extent permitted by law.

Each Member indemnifies GeeMyCard for and against any loss or claim suffered or incurred by GeeMyCard or any other party arising from or in connection with a breach of these terms and conditions by a Member.

GeeMyCard holds and uses a Member's personal information in accordance with GeeMyCard’s privacy policy, a copy of which may be obtained on www.geemycard.com.

Any decision taken by GeeMyCard in connection with any aspect of the membership program will be binding and final on each Member and no correspondence will be entered into.

GeeMyCard reserves the right to vary these Terms at any time for any reason and without notice.
